We respect your privacy and will protect your personal information and keep it confidential. This policy tells you how Monty Legal Consultants (Pty) Limited (MLC) will process and protect the personal information you share with us.

As a legal consultancy it has always been and remains our priority to keep your information private and confidential and abide by legal privilege in line with the law society’s rules. Unless the law requires otherwise, MLC keeps the affairs of present and former clients confidential.

As a processor of personal information as described by the Protection of Personal Information Act (POPIA), MLC abides by all provisions of POPIA and this Privacy Policy intends to set out how we may collect personal information, use it, secure it and what rights you may have in relation thereto.

Collection of personal information

  • While you use this website, we may collect your personal information or you may provide it to us (for example by enquiring or contacting us). For example, your name, email address or telephone number.
  • When you ask us for advice or instruct us, we may collect your personal information.
  • We might collect your publicly available personal information from the Internet. For example, your address or VAT registration number to send you a quote or invoice.
  • We may ask you to provide us with personal information where we are required by law to verify the identity of our clients.
  • You will need to share personal information with MLC to enable it to provide you with its services. If you do not want to share your personal information with MLC it will not be able to assist you.

  • send you a quote
  • send you an invoice

  • provide you with our services
  • send you updates on the latest legal developments
  • for collection of fees

MLC may share your personal information with the following persons.

  • Its employees and/ or third-party consultants or specialist legal advisors who are involved in your matters, enquiries and/ or accounts.
  • Its marketing agencies.
  • Parties in legal matters and/or due diligence investigations which we are assisting you with and on your behalf.
  • Persons appointed by MLC and with whom we may share your personal information as referred to above are contractually bound to keep all personal information and confidential information private and confidential and abide by this policy.
  • where the law requires us to disclose your personal information.

MLC will not otherwise share your personal information to anyone unless you have consented to MLC doing so.

Security of Personal Information

We take all reasonable and appropriate organizational measures to keep your personal information secure. For example, we encrypt our laptops and our phones. However, we cannot guarantee the absolute security of it. We also back-up all your personal information on a regular basis.

Email Inspection

We will inspect all emails you contact us with via the email addresses that we provide on this website. We do this to check for viruses, and reserve the right to monitor and inspect all material and information transmitted over our system. We may also monitor whether you read emails that we send you.

Your Rights

  • You may enquire what personal information MLC holds about you.
  • access free of charge the information about yourself stored by us and its use.
  • You may request that we correct or delete personal information we hold, if necessary.
  • Where we are not required to legally keep your personal information, you may ask us to delete it.
  • You may opt out of any of our marketing efforts at any time.
  • You may object on reasonable grounds to the processing of your personal information.
  • You may withdraw your consent to the processing of your personal information
  • You can exercise these rights by emailing us.
  • You also have the right to lodge a complaint with a Regulatory Authority about how we process your Personal Information.

How long do we keep personal information

  • We will keep your personal information for as long as is necessary to fulfil the purpose for which it was collected and for so long as is required to comply with legal obligations, legislation, resolve disputes, protect our assets, or enforce agreements.

Personal Information of juristic persons and person related to juristic persons

  • If you are a juristic person (like a company or close corporation), we may collect and use personal information relating to your directors, officers, employees, beneficial owners, partners, shareholders, members, authorised signatories, representatives, agents, payers, payees, customers, guarantors, spouses of guarantors, sureties, spouses of sureties, other security providers and other persons related to you. These are related persons.
  • If you provide the personal information of a related person to us, you warrant that the related person is aware that you are sharing their personal information with us and that the related person has consented thereto.
